1. Acceptance of Terms

Welcome to WhichDrawer. These Terms of Service ("Terms") govern your access to and use of the WhichDrawer mobile application and related services (the "Service") provided by WhichDrawer ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

WhichDrawer is a mobile application that helps you:

• Track and organize items stored in drawer organizers, bins, and containers
• Create visual inventories with photos and descriptions
• Search for items using text and AI-powered image recognition
• Share organizers with family members or collaborators
• Use and share community layout templates

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You can register using:

• Email and password
• Sign in with Apple
• Sign in with Google

3.2 Account Responsibilities

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Age Requirements

You must be at least 13 years old to use the Service. By using WhichDrawer, you represent that you meet this age requirement.

4. Subscription Plans and Payment

4.1 Free and Paid Plans

WhichDrawer offers the following subscription tiers:

• Free: 1 organizer, basic features
• Standard: 5 organizers, AI image search, advanced features
• Pro: 25 organizers, all features, priority support

4.2 Billing and Payments

• Subscriptions are billed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your device's app store settings
• Refunds are subject to the policies of Apple or Google

4.3 Free Trial

We may offer free trials for premium features. After the trial period, you will be automatically charged unless you cancel before the trial ends.

4.4 Price Changes

We may change subscription prices. Existing subscribers will be notified in advance, and changes will apply to the next billing cycle.

5. User Content

5.1 Your Content

"User Content" includes photos, item descriptions, organizer names, and any other content you upload or create in the Service.

5.2 Content Ownership

You retain ownership of your User Content. By uploading content, you grant us a limited license to:

• Store and backup your content
• Display your content to you and users you've shared with
• Process images for AI search functionality
• Provide the Service as described

5.3 Content Guidelines

You agree not to upload content that:

• Infringes on intellectual property rights
• Contains illegal, harmful, or offensive material
• Contains malware or malicious code
• Violates any applicable laws or regulations

5.4 Community Templates

If you submit layout templates to the community:

• You grant other users the right to use your template
• Templates may be subject to moderation
• We may remove templates that violate guidelines

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems or bots to access the Service
• Impersonate others or misrepresent your affiliation
• Share your account credentials with others
• Use the Service to send spam or unsolicited messages
• Circumvent any access controls or usage limits

7. Intellectual Property

7.1 Our Rights

The Service, including its design, features, and content (excluding User Content), is owned by WhichDrawer and protected by copyright, trademark, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7.3 Feedback

If you provide feedback or suggestions, we may use them without any obligation to compensate you.

8. Third-Party Services

The Service integrates with third-party services including:

• Apple and Google for authentication and payments
• Cloud services for data storage
• AI services for image processing

Your use of these services is subject to their respective terms and privacy policies.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results from the Service will be accurate or reliable
• AI-powered features will correctly identify or locate items
• Your data will never be lost (we recommend keeping your own backups)

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHICHDRAWER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content
• Loss of profits or revenue
• Business interruption
• Personal injury or property damage

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless WhichDrawer and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

13.1 By You

You may stop using the Service and delete your account at any time through the app settings.

13.2 By Us

We may suspend or terminate your access to the Service if:

• You violate these Terms
• Your use poses a security risk
• Required by law
• We discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• We may delete your data after a reasonable period
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Sending an in-app notification or email
• Updating the "Last updated" date

Your continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Before filing a formal dispute, please contact us to try to resolve the issue informally.

15.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and WhichDrawer regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
